and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD). Users — and,
where applicable, parents, guardians or authorised representatives — are hereby informed of, and consent to, the incorporation of their data into

BOOKING
By completing your order, you agree to all the terms and conditions set forth by Well Contro Pro Academy S.L. (commercially known as MDS Academy), main office located at Plaza Costa del Sol No10, Edificio Entreplazas 1-98, Torremolinos 29620, Málaga, Spain.
A contract is considered valid upon receipt of the customer's written order confirmation, either via email or by completing our online booking form at https://www.mdsspain.com/booking.
MDS Academy (hereafter referred to as "MDS") will confirm the booking and provide an information pack.
Please review your course booking confirmation carefully. If any details are incorrect, contact MDS immediately. The customer is responsible for ensuring the accuracy of all information provided. MDS reserves the right to refuse or revoke services if false information is submitted, without prejudice to any other legal actions that may apply.
Additionally, the customer must have proper authorization to provide third-party data when required. MDS reserves the right to verify the validity of any credit or debit card used for booking.
COURSE START DATE & PRESENTATION
It is the candidate's responsibility to arrive on time at the course location. Full course details, including the start date, time, location, and MDS Joining Instructions, will be sent via email. MDS may not be able to accommodate late arrivals, and refunds or rescheduling are not guaranteed for those who fail to attend on time.
MDS is not responsible for any transportation costs incurred by the customer.
For face-to-face courses, all candidates must carry valid official photographic identification (e.g., passport or national ID card) at all times.
MDS OBLIGATIONS

Provide relevant study materials.

Supply educational resources, including materials, facilities, and necessary equipment. All equipment remains the property of MDS.

Deliver training courses; however, MDS makes no guarantees regarding the attainment of qualifications, exam results, or levels of knowledge achieved.

Maintain accurate records of candidates' performance.
CUSTOMER OBLIGATIONS

Pay all charges as specified on the invoice.

Ensure candidates attend the course on the specified date and location.

• Do not remove, copy, or reproduce MDS materials. All materials remain the property of MDS.

Ensure that all participants can read, understand, and communicate effectively (both verbally and in writing).

If using a Purchase Order system, ensure that MDS receives the order number before the course begins.
CANDIDATE RESPONSIBILITIES

Candidates must behave responsibly at all times. If MDS deems behavior unacceptable, MDS reserves the right to suspend or remove the candidate from the course without liability.

Alcohol and illegal substances are strictly prohibited on MDS premises. Any candidate found in possession of, or suspected to have consumed such substances will be required to leave immediately, and their employer will be notified.

Course materials may only be used for personal study. They may not be copied, shared, or distributed without MDS's prior written consent.
CERTIFICATION
Upon successful course completion, MDS will email the candidate and their employer (if applicable) a confirmation including:

OPITO® and GWO® names, logos and trademarks displayed on this website are used solely to identify training programmes available through MDS Academy.
MDS Academy acts as an independent training provider and training broker. OPITO and GWO courses advertised on this website are delivered by independently approved third-party training providers selected according to location, availability, language and operational requirements.
The display of OPITO® and GWO® names, logos or trademarks does not imply that MDS Academy is an OPITO Approved Centre or a GWO Certified Training Provider, unless explicitly stated otherwise. All trademarks remain the property of their respective owners.
HOTEL ACCOMMODATION
Hotel reservations are subject to each hotel's cancellation policy, which varies by season and hotel terms.
MDS acts only as a booking intermediary and holds no contractual responsibility for accommodations.
Upon request, MDS can assist with hotel bookings, coordinating reservations with partner hotels that may offer special rates.
For companies, MDS will include hotel charges on the course invoice (MDS administration fees apply).
For individuals, MDS can arrange hotel bookings, and payment will be made directly to the hotel upon arrival (MDS administration fees apply).
CHARGES AND PAYMENT
Confidentiality: Course fees provided to customers are confidential and must not be shared with third parties without MDS's prior consent.
Tax Responsibilities: The customer is responsible for any applicable local taxes and indemnifies MDS against such charges.

Payment Terms:

Companies: MDS invoices corporate customers on the final day of the course, payable within 30 days. Under Spanish law, services in Spain are subject to Spanish tax, except for companies with a valid European Intra-community tax number (which must be stated on the invoice) or those based outside Europe.

Individuals: Must pay in full before arrival via debit/credit card. Bank transfers can be arranged upon request.
Accepted Payment Methods: Visa, MasterCard, Switch/Maestro, AMEX, bank transfer, and cash (cheques not accepted).
Cash payments: Cash is accepted for face-to-face courses only. The full course amount must be paid in person at the training centre; no deposit is required or taken for cash bookings.
Late Payments: Interest accrues daily on overdue payments at the statutory rate under Spanish law (Law 3/2004 on combating late payment in commercial transactions).
WITHHOLDING TAXES (WHT) AND LOCAL TAX DEDUCTIONS
All prices and invoices issued by MDS Academy are net of any taxes, duties, or deductions that may be applicable in the client's jurisdiction.
If local laws require the client to withhold or deduct any amount from payments to MDS Academy (such as withholding tax or other similar levies), the client shall be responsible for bearing such taxes and shall ensure that the full invoiced amount, as stated by MDS Academy, is received in euros (EUR) without any reduction.
Any taxes or withholdings imposed in the client's country are solely the responsibility of the client. Where such taxes are mandatory, the client shall gross up the payment so that the net amount received by MDS Academy equals the total invoiced value.
COURSE CANCELLATION POLICY
MDS-Initiated Cancellations
MDS may cancel courses due to health, safety, operational issues, or unforeseen events. In such cases, MDS will either reschedule the candidate or offer a full refund.
Customer-Initiated Cancellations
Cancellations must be submitted in writing at least seven full days before the course start date to avoid charges.
Cancellations within seven days of the start date incur the full course fee.
Non-Attendance
Customers who cancel on the first day or fail to attend will be charged the full fee and will not be eligible for rescheduling.
REMOTE LOCATION COURSES
Booking: A 50% deposit is required at acceptance.
Short-notice bookings: Full payment is required three weeks before the start date.
Cancellations:
• If the customer cancels before any logistical arrangements have been made, or at least 14 days (2 weeks)

prior to the course start date, a full refund will be issued.

If cancellation occurs after arrangements have begun and within 14 days of the course start date, 30% of the course fee plus any incurred expenses will be retained.

If cancellation occurs within seven days of the course start date, no refund will be provided.
LIABILITY & TERMINATION
MDS is not liable for indirect economic losses. Any damage claims must be handled through insurance.
If either party breaches the contract and does not remedy it within seven days of written notice, the agreement may be terminated immediately.
COPYRIGHT & CONFIDENTIALITY
All course materials are MDS property and must not be copied or shared without written permission.
Customer data is handled in accordance with the GDPR (EU 2016/679) and Organic Law 3/2018 (LOPDGDD). Requests to modify or delete personal data must be sent in writing to MDS at info@mdsspain.com.
